Booking terms and conditions.

Please read these Booking Terms and Conditions carefully before requesting a reservation through this website.

These Booking Terms and Conditions govern the procedure by which users may request and manage restaurant reservations through the website owned by OSTERIA CONDAL.

Making a reservation through this website grants the user status as a website user and implies full and unconditional acceptance of these Booking Terms and Conditions, without prejudice to the acceptance of the Legal Notice, Privacy Policy and Cookies Policy.

2. PURPOSE

These Booking Terms and Conditions govern access to and use of the online booking system available on this website, through which users may request a table reservation at the restaurant, subject to availability and the applicable conditions in force at the time of booking.

3. BOOKING PROCEDURE

Users may request a reservation by completing the booking form or by using the online booking system available on this website, providing all information required for the correct processing of their request.

The booking request must include, at a minimum, all information marked as mandatory on the relevant booking form. The user warrants that all information provided is true, accurate, complete and up to date.

Submitting a booking request shall not, in itself, constitute confirmation of the reservation unless this is expressly indicated on the final booking confirmation screen or by means of the relevant confirmation email, message or other confirmation communication.

OSTERIA CONDAL reserves the right to contact the user using the details provided in order to confirm, verify, amend or complete the booking request whenever necessary for the proper provision of the service.

4. BOOKING CONFIRMATION

A reservation shall only be deemed confirmed once the user has received an express confirmation from the restaurant or where confirmation is clearly indicated at the end of the booking process.

The availability displayed on the website is indicative only and may change until the reservation has been formally confirmed.

OSTERIA CONDAL reserves the right to refuse or decline a booking request in any of the following circumstances:

  • Lack of availability.
  • Material or technical errors affecting the booking system.
  • Incomplete or incorrect information.
  • Duplicate bookings.
  • Reasonable grounds to suspect fraudulent, abusive or bad-faith use of the booking system.
  • Subsequent inability to provide the service due to organisational reasons, technical issues or events of force majeure.


5. AMENDMENT AND CANCELLATION OF BOOKINGS

Users may request amendments to or cancellation of their reservation through the channels made available on the website or by contacting the restaurant directly, provided sufficient notice is given.

Requests for amendments or cancellations shall be subject to availability and to any specific conditions applicable in each case.

Where a reservation is subject to special cancellation terms, a deposit requirement or no-show charges, such conditions will be communicated to the user during the booking process or in the booking confirmation.


6. PUNCTUALITY AND GRACE PERIOD

In order to ensure the efficient organisation of the restaurant service, users undertake to arrive on the date and at the time specified in their reservation.
If users expect to arrive late, they are encouraged to notify the restaurant as soon as possible.

OSTERIA CONDAL may hold the reservation for a reasonable grace period after the scheduled booking time. Once this period has expired, if the user has neither arrived nor informed the restaurant of the delay, the table may be released without giving rise to any right to compensation or claim, unless the specific circumstances reasonably allow for an alternative solution.

7. GROUP BOOKINGS AND SPECIAL CONDITIONS

Reservations for groups, celebrations, private events or special services may be subject to specific conditions different from those applicable to standard bookings.

In such cases, OSTERIA CONDAL may request additional information, establish specific amendment or cancellation terms, require a deposit or restrict certain service options for organisational reasons.

Any such specific conditions will be communicated to the user before the reservation is finally confirmed.

8. BOOKING GUARANTEE, DEPOSITS AND NO-SHOWS

For certain reservations, particularly during peak periods, special occasions, group bookings or events, the restaurant may require a booking guarantee by means of a payment card, card pre-authorisation or payment of a deposit.

In such cases, users will be informed, before confirming the reservation, of:

  • The amount of the required deposit or guarantee.
  • The applicable cancellation policy.
  • The circumstances in which a no-show or late cancellation charge may apply.
  • The applicable refund conditions, where relevant.

Failure to attend without prior notice or cancellation outside the permitted period may result in the forfeiture of the deposit or the application of the relevant charge, provided that these conditions have been clearly communicated and expressly accepted during the booking process.

9. SPECIAL REQUESTS

Users may include comments or special requests relating to their reservation, such as accessibility requirements, high chairs for children, celebrations, seating preferences or information regarding food allergies and intolerances.

The restaurant will make every reasonable effort to accommodate such requests; however, they remain subject to availability and operational capacity and cannot be guaranteed unless expressly confirmed by OSTERIA CONDAL.

Users are kindly requested to provide only the information strictly necessary for the proper management of their reservation.

10. USER OBLIGATIONS

Users undertake to:

  • Provide true, accurate and up-to-date information.
  • Refrain from making false, duplicate or speculative bookings.
  • Not misuse the booking system or use it fraudulently, abusively or in bad faith.
  • Respect the restaurant’s basic rules of conduct and operation.
  • Notify the restaurant as early as possible of any amendment to or cancellation of their reservation.

Where these obligations are breached, OSTERIA CONDAL reserves the right to cancel the reservation or restrict future booking requests submitted by the user, provided such measures are proportionate and in accordance with applicable law.

11. PRICES OF PRODUCTS AND SERVICES

Unless expressly stated otherwise, making a reservation through the website does not in itself require any payment. However, certain services, tasting menus, events, promotions or special reservations may require a deposit, advance payment or be subject to specific pricing conditions.

Information relating to prices, menus, promotions and special conditions published on the website is provided for information purposes only and may be amended at any time unless expressly stated to be binding.

12. PERSONAL DATA PROTECTION

The personal data provided by users during the booking process will be processed by OSTERIA CONDAL for the purposes of managing, confirming, amending or cancelling the requested reservation and dealing with any matters or requests arising from it.

13. LIABILITY

OSTERIA CONDAL shall not be liable where it is unable to complete or manage a reservation due to circumstances beyond its reasonable control, including connectivity failures, booking system incidents, service interruptions, technical faults affecting the user’s device or events of force majeure.

OSTERIA CONDAL also reserves the right to modify, suspend or discontinue, temporarily or permanently, the online booking system whenever necessary for technical, operational, maintenance or security reasons.

14. AMENDMENTS TO THE BOOKING TERMS AND CONDITIONS

OSTERIA CONDAL reserves the right to amend these Booking Terms and Conditions at any time and without prior notice. The current version will remain permanently available on this website.
In any event, the terms applicable to the user shall be those in force at the time the booking request is submitted, unless otherwise required by law or by a decision of the competent authority.

15. APPLICABLE LAW AND JURISDICTION

These Booking Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.
Any dispute arising from the interpretation, validity or performance of these Booking Terms and Conditions shall be submitted to the courts having jurisdiction over the user’s place of residence where the user is acting as a consumer. In all other cases, jurisdiction shall lie with the courts of Alicante, Spain, unless otherwise required by applicable law.
